Data Use & Privacy Policy 

At The Layered Onion, we are committed to treating your data with care. In this document, we explain how we do so, and the options which we provide in order to allow you to choose how your data is used by The Layered Onion, Inc. (“The Layered Onion”) when you use our website, www.thelayeredonion.com, and any of our services (our “Services”). 

Our Data Use & Privacy Policy explains our privacy practices for The Layered Onion, our Services, our payments platform (“Payments”), our public Application Program Interface (the “API”), data analytics (“Analytics”) and any other Services provided by us (“us,” “we”). 

This page informs you of our policies regarding the collection, use and disclosure of Personal Data when you use our Services and the choices you have regarding that data. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions. 

To protect your Personal Data, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. 

This policy does not apply to any third parties (including other members who sell using our Services or API users) who may collect or receive data in connection with your use of our Services. 

CONSENT 

We use your data to provide and improve the Services. By using the Services, you agree to the collection and use of data in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions. 

When you provide us with Personal Data to complete a transaction, verify your credit card, place an order, arrange for a delivery, or return a purchase, you provide us with your consent to collect the data and use it for that specific reason only. If we ask for your Personal Data for a secondary reason, such as marketing, we will either ask you directly for your express consent or provide you with an opportunity to say opt-out.

DATA WE COLLECT 

Personal Data 

Upon registration we may ask you to provide us with Personal Data, which may include, but is not limited to, your e-mail address and the username used to register for an account with us. 

We may use your Personal Data to contact you with newsletters, marketing, or promotional materials. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us. If you choose to post on The Layered Onion’s blog or opt-in to being promoted on our social media, you may be asked to provide links to any of your social media accounts. 

Usage Data 

We may also collect Usage Data. This Usage Data may include data such as your computer’s Internet Protocol (IP) address, browser type, browser version, the pages of our Services that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. 

When you access the Services with a mobile device, this Usage Data may include data such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your  

mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data. 

Location Data 

We may use and store Location Data. We use this data to provide features of our Services, and to improve and customize our Services. You can enable or disable your location services when you use our Services at any time by way of your device settings. 

Tracking & Cookies 

We use Cookies and similar tracking technologies to track the activity on our Services and we hold certain data. Other tracking technologies are also used, such as beacons, tags, and scripts to collect and track data and to improve and analyze our Services. 

You can instruct your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if you do not accept Cookies, you may not be able to use some portions of our Services.

Session Cookies. We use Session Cookies to operate our Services. 

Preference Cookies. We use Preference Cookies to remember your preferences and various settings. 

Security Cookies. We use Security Cookies for security purposes. 

THIRD PARTIES 

Our Services may contain links to third-party websites or services that we do not own or control (for example, links to Facebook, Twitter, or another business). You may also need to use a third party’s product or service in order to use some of our Services (such as a compatible mobile device). In general, the third-party providers used by us will only collect, use, and disclose your data to the extent necessary to allow them to perform the services they provide to us.  

Third parties may require you to accept their own agreements in order to use their services. The Layered Onion is not a party to those agreements; they are solely between you and the third party. We advise you to review the Privacy Policy of every site you visit. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party sites or Services. 

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service. 

Links to Other Sites 

Our Services may contain links to other sites that are not operated by us. If you click a third-party link, you will be directed to that third party’s site.  

API 

We use a third-party Application Public Interface, WordPress, to build our website. WordPress includes some analytical and functional plug-ins. The Layered Onion is using JetPack through WordPress for analytics, and MemberPress for subscription Services. The privacy policies for these WordPress services can be found at:

Analytics 

We use a third-party analytics service, Google Analytics, to monitor and analyze the use of our Services. 

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Services. This data is shared with other Google Services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. Payments 

Our store is hosted by Stripe, Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you. If you make payments to us via the Services, we use Stripe to process and accept payments. We do not store any credit card data, but Stripe will collect credit card data and any other payment-related data. Stripe uses the payment-related data that it receives as necessary and appropriate to fulfil requests to process payment transactions, to facilitate billing, and to otherwise deliver payment services. Personal Data about our users is used by such services to process payment transactions and for no other purpose, and this data is subject to Stripe’s privacy policy and terms of use: https://stripe.com/terms 

Stripe, Inc. stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction data is deleted. 

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card data by our store and its service providers.

Other Third Parties 

From time to time, The Layered Onion will grant other third parties access to your Personal Data to perform certain work on our behalf. These third parties are obligated not to disclose your Personal Data or use it for any other purpose than performing our work.  

We also use your Personal Data to communicate with you. We may send certain mandatory Services communications such as welcome letters, billing reminders, data on technical Services issues, and security announcements. Additionally, with your permission, we may also occasionally send you surveys or promotional mailings to inform you of other products or Services available from us or our affiliates, and/or share your Personal Data with our business partners so they may send you data about their products and Services. 

We may partner with companies that further our vision and mission. We may also use outside vendors to improve our Services to our online community. We will provide a current list of our partners and vendors to anyone who is interested. Please request via [email protected].  

MISCELLANEOUS 

Retention 

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with disclosure requirements, resolve disputes and enforce our legal agreements and policies. 

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer periods. 

Disclosures 

We may disclose your Personal Data if you violate our Terms of Service. Under certain circumstances, we may be required to disclose your Personal Data if required to comply with a legal obligation, such as to: 

  • protect and defend our rights or property 
  • prevent or investigate possible wrongdoing in connection with the Services 
  • protect the personal safety of users of the Services or the public 
  • protect against legal liability

By using our Services, you represent to us that you are at least eighteen (18) years of age. You must be 18 years or older to use our Services without the supervision of a parent or legal guardian; individuals under this age are considered legal minors (“Minors”).  

We do not knowingly collect any Personal Data from Minors. If we become aware that we have collected Personal Data from a person under the age of 18, we take steps to remove such data.

Business Transactions 

If we are involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy. 

Changes to This Privacy Policy 

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the “effective date” at the top of this Privacy Policy. 

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on our Site.

By using our Services, you represent that we can send you information electronically (such as by email), and that at any point while using our Services, your electronic agreement is the same as your signature on paper.
